'No questions Your Honour' – the future of proof and evidence in construction disputes

  1. This paper will examine the change in the way common construction claims may be substantiated  in the future. It will investigate and analyse how recently-developed technologies currently (or predicted to soon be) utilised on construction sites will affect:
    • the type of evidence sought to be relied on in proving construction claims; and
    • the collation and presentation of such evidence in the various forms of construction dispute resolution, including adjudication, arbitration and litigation..
  2. The issues these developments present for lawyers are then considered.
