Emerging issues in the use of technology for managing documents in construction disputes

This paper examines the issues arising out of the spread of ‘artificial intelligence’ and other technological developments in the management of data and documentation by the construction industry. It particularly focuses on the increasing use of ‘TAR’ or predictive coding technologies in the document disclosure process for construction disputes. It considers how such technologies may change the approach of courts, legal practitioners and construction industry players to what has always been a vexing problem for the construction industry.
