On 1 August 2022, the operative provisions of the Building and Construction Industry (Security of Payment) Act 2021 (WA) came into effect. These provisions replaced the existing security of payment model under the Construction Contracts Act 2004 (WA); establishing new payment claim and rapid adjudication systems in Western Australia. The Act also now applies to a wider range of construction projects in the mining and energy sectors.

While the new regime draws from the existing ‘East Coast Model’ in NSW and other jurisdictions, the Act includes unique features such as:

  • a mechanism for a claimant to seek a declaration that an ‘unfair’ time bar provision is of no force and effect in relation to a particular claim; and
  • a mandatory requirement to give notice when calling on security.

In this session, our panel of speakers discuss the changes arising under the Act and offer practical guidance for navigating WA’s new security of payment regime. Each of our panel members hail from different professional backgrounds and together bring a diverse range of insights in this space.

The event will formally commence at 5:30 pm AWST. There will be time for attendees to ask questions at the conclusion of the panel discussion, followed by networking drinks.
