NSW Building & Development Certifiers Regulation 2020

On 4 March 2020, the Building and Development Certifiers Regulation 2020 (the Regulation) was finalised and published on the NSW legislation website.  The Regulation has been developed to support the Building and Development Certifiers Act 2018 (the Act), which was passed by Parliament on 24 October 2018.

The purpose of the Regulation is to set out the requirements for the registration of registered certifiers including classes, qualifications, experience and knowledge, to provide Code of Conduct standards, to establish contract requirements for certification work and to create a new accreditation framework. It also contains applicable fees and penalties.

The Act and Regulation will both commence on 1 July 2020. Upon commencement, the Act and Regulation will replace the Building Professionals Act 2005 and the Building Professionals Regulation 2007.
