The Society is pleased to announce a forthcoming video seminar on carbon pricing. The seminar, entitled 'A Price on Carbon - Consequences for the Construciton Industry', will take place on Wednesday 19 October 2011. The seminar will be the next in our series of video seminars. We will be linking Perth, Brisbane, Adelaide, Melbourne, Sydney, Auckland and London. The flyer in relation to the seminar can be found at A Price on Carbon. Members may be interested in the forthcoming closure of nominations for the Tom Yuncken - Young Construction Lawyer Award. The biannual award is announced by the Melbourne Construction and Infrastructure Law Committee of the Business Law Section of the Law Council of Australia. Nominations close on 17 October 2011. In Adyard Abu Dhabi v SD Marine Services [2011] EWHC 848, Justice Hamblen considered the approaches to assessment of EOT claims when there is concurrent or “parallel” delay. In Jerram Falkus Construction Limited v Fenice Investments Inc No 4 (2011) EWHC 1935 (TCC) Justice Coulson considered the application of the prevention principle but concluded in the case that even if there had been delay for which the Principal was responsible that delay would have been concurrent with the Contractor’s delays and therefore the principle was not enlivened. In Project Company No. 2 Pty Limited v Cushway Blackfords & Associates Ltd [2011] QCA 102 the Queensland Court of Appeal allowed an application by a contracting owner corporation to join its parent company which had in fact suffered the loss caused by negligent design of a switchboard.
