The Australian Legislation Reform sub-committee (formerly the Domestic Legislation sub-committee) will be focussing, as the name suggests, on the development, campaigning and research into issues relevant to our members and the practice of construction law. The aim of the ALRS is to represent the collective views of our Society of Construction Law Australia members in furthering and progressing worthwhile discussion, debate and legislative reform relevant to the construction industry.
As our first major initiative, the ALRS has been tasked by the Executive Committee to consider the security of payment legislation in Australia. We propose looking into this particular Act and getting views of the various Government players and reporting to the membership about this and other initiatives.
In the coming months, the ALRS will be seeking submissions and comments from our members on this issue and aims to identify a consensus on whether and what reform may be appropriate or required in Australia. Further detail about this current task of the ALRS is set out in our communiqué.
Given the enactment of security of payment legislation in South Australia, Tasmania and the ACT, every state and territory in Australia now has its own regime, which are loosely based on either the "East Coast" model or "West Coast" model. This has led to discussion, consideration and debate on the hot topic of whether a harmonised regime throughout Australia is achievable or even worthwhile.
